DATA PRINCIPAL RIGHTS

Understand the rights in Sections 11–14.

The Act sets out rights for individuals, subject to its terms and applicable Rules. As at 23 September 2026, Sections 11–14 are in the eighteen-month commencement tranche identified by G.S.R. 843(E).

Rights provisions

Section 11 · Access information

Provides for access to a summary of personal data and related information within the statutory scope and subject to the Act’s terms.

Section 12 · Correction and erasure

Addresses correction, completion and updating of personal data, and erasure where applicable, subject to the Act and necessary retention.

Section 13 · Grievance redressal

Provides for grievance redressal. Rule 14 specifies a reasonable response period not exceeding 90 days when operative.

Section 14 · Nomination

Provides for nomination of another individual to exercise rights on death or incapacity, in accordance with the Act.

Avoid shortcuts

Erasure is Section 12. The Act does not create a general 72-hour erasure deadline. Request handling depends on the statutory text, commencement, facts and any applicable retention requirement.
